The Nightime Gallery undertakes to best meet the wishes of its customers, with regard to the purchase of works and products that the Gallery offers; on its site for online sales or direct sales.

Nature and purpose
The General Terms and Conditions of Sale below define all the rights and obligations of each party in the context of the online sale, by the company Nightime, of the products offered to customers. These conditions become applicable upon validation of a purchase on the nightimegallery.com site.
Orders
All prices are expressed in Euros all taxes included, excluding shipping costs.
By checking the box "I accept the general conditions of sale", the customer declares to have read and accepted the General Conditions of Sale of Nightime, described below, and can then proceed to the secure payment online.
The gallery cannot be held responsible if the issuer provides incorrect information when completing the purchase form and personal data
The final validation of the order will state proof for the order and thus entitles Nightime to demand payment for the products ordered. This validation is worth signature and approval of all the operations carried out on the site nightimegallery.com.
Payment
When validating the order, the price indicated corresponds to the entire purchase price, packaging and shipping. The necessary delivery costs cannot call into question the validation of the final order.
The buyer can pay either by credit card on the site or by bank transfer by prior request made by email to contact@nightimegallery.com.
Refusal of bank payment authorization by the banking center entails full cancellation of the order without compensation. If an error occurs during the registration of the order, it will be considered null and void, the customer will therefore have to repeat the order operation. The order is validated and recognized upon payment stipulated irrevocably, net and without discount.
The Nightime company reserves the right to suspend any order or delivery in the event of refusal of payment authorization required by the official bodies or in the event of non-payment by the buyer. Just as the company Nightime reserves the right to refuse delivery or to take into account an order from the moment a payment dispute exists, not having paid partially or totally a previous order.
Withdrawal, Exchange and Refund
In accordance with article L121-20 of the consumer code, the physical or moral purchaser has a legal period of 7 days to withdraw, from the delivery of his order in order to return for exchange or refund without penalties, however the return costs are the responsibility of the buyer.
The buyer will then be asked to contact the Nightime company at contact@nightimegallery.com to obtain the terms of return to be respected. Returned items must be in their original packaging and condition, with no trace of use.
The delivery costs for the dispatch and/or return of all goods are the responsibility of the purchaser or buyer.
Upon receipt of the intact products, exchange or refund procedures can be carried out.
Delivery
Deliveries can only be made from Monday to Friday, not public holidays, and excluding weekends.
The cost of delivery is not included in the price of the products displayed, but as soon as your address is validated, the amount of the shipping costs is calculated and automatically added to the total amount to be paid.
The delivery is made by UPS, which allows the buyer to follow the shipment of the package until receipt. The package is delivered against signature.
Delivery times can go up to 3 days in France and up to 8 to 10 days for Europe and the rest of the world, from the day of dispatch.
The information concerning the tracking of parcels is only available for a period of 1 month, so do not hesitate to contact us for any follow-up request or information, during this period.
The Nightime Gallery declines all responsibility when the carrier does not respect the usual delivery times and no refund can be claimed from the gallery. It is the same as the gallery, is no longer responsible as soon as the carrier takes charge of the package.
Receipt of order
Upon receipt of the order, the buyer must check the good condition of the goods.
If the customer finds that the package or its contents have been damaged in any way whatsoever (pierced, open or damaged package, missing, damaged or broken product), the customer must refuse the package and note a reservation on the slip. carrier delivery
The customer must then formulate a reasoned complaint with the carrier within 48 hours of delivery and by registered letter with AR.
The buyer is responsible for informing the Nightime Gallery of any reservations about the contents of the delivery, on the day of receipt or at the latest on the first working day following receipt, at contact@nightimegalerie.com.
Rights of works and properties
The transfer of ownership of a work from the gallery to a client is only valid upon full payment to the Gallery.
However, the copyrights of an artist to his work are not transferred and the artist always remains the owner of these rights.
The buyer, by committing to the purchase of a work and taking possession of it, becomes responsible and declares respect for the work of its use.
Finally the artists and the Nightime Gallery collaborate together for the rights of representation and reproduction and Nightime Gallery owns the site and its content.
Any reproduction of a work without the consent of its author is strictly prohibited and punishable by law (Art.L122-4 of the code of intellectual property of works).

Only the French text of these conditions of sale will prevail. Translations into other languages are for information only. If a provision hereof is considered invalid by a competent jurisdiction, this invalidity will not affect the other provisions which will retain all their effects.
